A 20-year-old man of Maseipei cattlepost near Bodibeng village accused of raping his 20-year cousin of the same cattle post is set to stand trial next year July.
The accused person who is currently out on bail is facing a single count of rape in which he is alleged to have on the 10th January 2021 had canal knowledge with the complaint without her consent. The accused person was 18 years at the time of committing the offence.
Appearing before Maun Chief Magistrate Thebeetsile Mulalu recently the accused person who pleaded not guilty to the offence told court that the victim had consented to the sexual intercourse. He noted that he does not have any witness as they were only two in the bush.
Mulalu noted that according to a medical report, genital swabs taken from the complainant entailed a DNA of the accused person. He noted that this indicates that there was intercourse between the accused person and the complainant.
He set the 29th and 30th July 2024 as a date for commencement of trial.
According to court papers, it is said that on that fateful day the complainant’s mother asked the complainant to go and fetch firewood in the nearby bush. It is said that the complainant went into the bush to collect fire wood, while in the bush it is said that she heard someone calling out her name.
It is alleged that the accused person then emerged from the bushes where he then allegedly asked the victim if she remembered what they used to do together and allegedly preceded by grabbing the complainant as she tried to run away.
The accused person is said to have then put his hands over the complainant’s mouth, took off her panties and inserted his manhood into the victim’s genitals without her consent. It is said that after the alleged incident occurred the victim went home and told her mother of what had happened and the matter was reported to the police.
The accused person was then arrested by the police and taken to the station where he denied raping the complainant. They were both interviewed and the complainant is said to have maintained that he had canal knowledge with her without her consent.
The accused person will appear on the 28th May 2024 for confirmation of trial dates.
