Maun Chief Magistrate Thebeetsile Mulalu has sentenced a 48-year-old man of Newtown in Maun to 10 years in prison for raping his 17-year-old step daughter.
The accused person, who pleaded guilty to the offence is said to have had canal knowledge of the complainant on March 4th 2023 at New Town. The teenager had been sent by her mother to give the convict food at his work place where he is a security guard.
Delivering the sentence, Mulalu indicated that he took into consideration the fact that the accused person was a first time offender and had not wasted the court’s time, instead pleading guilty for the offence.
Mulalu noted that he also took into account the accused person’s mitigation plea for the court to impose a lenient sentence and that he is a bread winner to his sick mother and minor child who are under his care.
However, Mulalu also said he considered the fact that the accused person stands convicted for a serious sexual offence hence he should receive punishment for such. He added that sexual offences have become prevalent in the North West jurisdiction therefore stiff measures needed to be put in place to protect young girls and women from sexual abuse.
“I have failed to find any extenuating circumstances that may have led the accused person to have had sexual intercourse with his step daughter. The accused person did not have any reasons to why he had done that and I therefore sentence him to 10 years in prison, taking into account the 42 days accused spent in custody pending sentencing,” Mulalu delivered the sentence.
According to court papers, on that fateful day the complainant was sent by her mother to deliver food to the accused person where he worked as a security guard. After delivering the food, the accused person insisted on walking the minor back home. Along the way, they passed a deserted house and the accused person reportedly ordered the complainant that they she accompany her inside the house, to which she declined.
Following her resistance, the accused then decided that they take a different route which passes through the river, where upon he began touching the complainant’s breasts and private parts. He is alleged to have then undressed the complainant and proceeded to have sexual intercourse with her without her consent using a condom.
Upon arrival at home, the complainant narrated the ordeal to her mother who then reported the matter to the police. During investigations a used condom is said to have been recovered from the scene.
The used condom was then taken to the forensics for DNA testing where the results reflected that a mixed DNA relating to the complainant and the accused was found on the condom.
