A Botswana Defence Force Lance Corporal, Mosimanegape Nyathi has been dragged before the Maun Magistrate’s Court charged for assault common and threat to kill.
The 32-year-old accused person who is currently out on bail is alleged to have, on the 19th of August 2022 at Newtown in Maun unlawfully assaulted one Gofiwa Masego by slapping her and hitting her with fists. He is also alleged to have on the same day and place threatened to kill the same complainant.
On the first count, it is said that on the evening of that fateful day the complainant was at her place of residence baby-sitting children, when the accused person reportedly arrived and requested that she accompany him.
The complainant is said to have rejected the accused person’s request as she was still babysitting, and infuriated by the rejection Nyathi allegedly began to assault Masego who then escaped into a room and locked herself inside.
The accused person reportedly left the place but came back after some time now accompanied by his brother and he once again ordered the complainant to go with him to his place but she refused.
Nyathi is said have then started assaulting Masego again and forcefully lifted and put her into his car and locked her inside. Following the assault, he reportedly asked his brother to drive the car who refused. The accused person is said to have then gotten out of the car, and while proceeding to the driver’s side, the complainant managed to open the door and escaped to her neighbour’s place where she spent the night.
Upon arrival at her residence the following day she was informed that after she fled the accused person said he was going to kill her by uttering the words “Masego o lucky, ne ke re ko mmolaya a be ke mo latlhela mo nokeng ya Thamalakane,” translating to “Masego is lucky, I was going to kill her and throw her into the Thamalakane river.”
Nyathi has since pleaded not guilty to both charges and he intend to seek legal representation. He will appear in court again for case management and conferencing on the 23rd February 2024.
